The Creator Funnel

Terms of Service

Version 3, published Oct 29, 2026

DRAFT — not legal advice; have a lawyer review. Delete this line before publishing. Items marked [TO CONFIRM: ...] must be settled first. Updated 2026-10-28 for Decision #34 (90-day free start on Starter, plan names Starter / Growth / Pro, page limits, the footer badge).

These Terms of Service ("Terms") are an agreement between you and Alpha Lion Enterprises LLC, 2035 W Monte Cristo Ave, Phoenix, AZ 85023, USA ("we", "us", "our"). They cover your use of The Creator Funnel at thecreatorfunnel.com, including its dashboard, the creator sites we host and everything that comes with it (the "Service").

By ticking the box at sign-up, or by using the Service, you agree to these Terms. You also agree to our Privacy Policy, Acceptable Use Policy and Data Processing Agreement, which are part of these Terms. If you are agreeing for a business, you confirm that you can bind that business, and "you" means the business.

Please read section 20 carefully. It says that most disputes will be decided by binding individual arbitration, not in court, and that you give up the right to take part in a class action. You can opt out of arbitration within 30 days (see section 20.5).

1. What The Creator Funnel is

The Creator Funnel is a hosted service for creators. It lets you run a website with sales pages, sign-up pages for free products, paid digital products, an email list, email sequences and broadcasts, a help desk and AI writing tools. We host the software and your site. You run your own business on it.

You connect your own accounts with other companies:

  • Stripe to take payments from your customers.
  • Resend to send and receive email.
  • OpenRouter for the AI writer and AI product builder (optional).
  • Optional extras such as Google Analytics or Plausible, the Meta, Google Ads and TikTok pixels, Cloudflare Turnstile and the YouTube Data API.

Money from your sales goes straight to your Stripe account, never through ours. Those companies bill you directly for their services under their own terms. We are not a party to your agreements with them and we are not responsible for what they do.

2. Your account

  • You must give us accurate details and keep them up to date. You sign in with Google or with an email address and password.
  • You must be at least 18 years old and able to enter a binding contract. The Service is not available to anyone under 18.
  • The person who signs up owns the billing account. One billing account has one plan, which can cover several workspaces (sites), up to the number your plan allows.
  • Account Owners must turn on two-step login before connecting any keys. You are responsible for keeping your login details and keys safe, and for everything done under your account, including by team members you invite.
  • Tell us straight away through the contact form at thecreatorfunnel.com if you think someone has got into your account.

3. Plans, trial and payment

  • Plans. Our plans, prices and what each plan includes (such as the number of workspaces, subscribers, products, pages, custom domains, storage and team seats) are shown on our pricing page and on your Billing screen. Prices are in US dollars. The current plans are Starter, Growth and Pro.
  • Free start on Starter. The Starter plan is free for your first 90 days. A card is required to start it, and nothing is charged during the free days. At the end of the 90 days your card is charged automatically ($4.95 per month at the time of writing) and the plan continues as a paid monthly subscription unless you cancel before the free days end. We email you a reminder about 3 days before the first charge. One free start is allowed per person, email address and card; a repeat sign-up, or a sign-up with a card already used for a free start, is billed from the day you sign up. Growth and Pro are billed from the day you sign up, with no free days.
  • Platform badge. Sites on the Starter plan show a small "Made with The Creator Funnel" link in the footer. Growth and Pro sites do not.
  • Renewal. Subscriptions renew automatically each billing period, and we charge the card on file, until you cancel.
  • Payment processing. Our subscription billing is handled by Stripe. We do not see or store your full card number.
  • Taxes. Prices exclude applicable taxes. Where we are required to collect tax, we will show it at checkout.
  • Price changes. We may change our prices. Existing subscribers normally keep their current price. If we decide to move existing subscribers to a new price, we will email you before it takes effect at your next renewal, and you can cancel before then.
  • Coupons. Promotion codes are subject to the terms shown with them (for example duration, expiry and "first-time customers only"). They have no cash value.
  • Refunds of our fees. Fees are not refundable, including for part of a billing period, except where the law requires otherwise or where the Data Processing Agreement gives you a prorated refund (if you end the Service after objecting to a new sub-processor). The 90 free days on the Starter plan are your chance to try the Service before you pay. If you cancel, your plan stays active until the end of the period you have paid for and then does not renew.

4. Changing plans and cancelling

  • You can upgrade, downgrade, change your card, see invoices and cancel at any time in the Customer Portal, which you reach from the Billing screen.
  • Cancelling stops future charges. Your plan stays active until the end of the period you have paid for. After that your account is cancelled (see section 5).
  • Downgrading below what you use. Nothing is deleted. You cannot add more than the new plan allows. You have 14 days to choose which products, domains and team members stay active; after that the newest extras are unpublished or deactivated (not deleted) and come back if you upgrade. Pages you already built over the new plan's page count are kept and stay editable; you simply cannot create more until you upgrade. If you have more workspaces than the new plan allows, the newest extra workspaces become read-only at once: their site, checkout and customer access stay up, but editing and email sending pause until you are back within your plan.
  • Subscriber limit. If your list grows past your plan's subscriber limit, we keep accepting and confirming new sign-ups, but broadcasts and new sequence enrolments pause until you upgrade or clean your list. Receipts, purchases and downloads keep working.
  • Fair use. Each plan includes a fair-use amount of marketing email per month. Above it, sending is slowed, not stopped.

5. If a payment fails, and what happens after cancellation

The times below are our current defaults and may change; we will tell you about any change that affects you.

  1. Payment failed: everything keeps working. We email you reminders.
  2. 7 days later, still unpaid ("limited"): your site keeps working, but the dashboard becomes read-only except Billing, Data export and help desk replies. No broadcasts or new sequences.
  3. 14 days after that ("suspended"): your public site shows "This site is unavailable" and checkout is turned off. Your customers can still reach the products they bought, and unsubscribe links keep working. You can still use Billing and Data export.
  4. Cancelled: same as suspended. You can resubscribe or export your data.
  5. 30 days after cancellation: your workspaces are scheduled for deletion and then permanently deleted (see section 13).

Paying the overdue amount at any point before deletion returns your account to normal.

6. Your content and your business

  • You own your content: your pages, products, emails, images, files, lists and other material ("Your Content"). You give us a licence to host, store, copy, process, display and send Your Content only as needed to run the Service for you, including backups.
  • You are the seller. When you sell a product through the Service, the sale is between you and your customer. You are responsible for your products, prices, refunds, customer service, delivery, taxes, receipts and any licences you need.
  • You are responsible for your own legal pages. Your site comes with starting templates for Terms, Privacy, Refunds and a Disclaimer. They are a starting point only. You must make sure the pages you publish are accurate and right for your business.
  • Truthful marketing. You are responsible for making sure your claims, testimonials, prices and email subject lines are true and lawful, including under FTC rules and the CAN-SPAM Act.
  • Rights. You confirm you have the rights to everything you upload, and that Your Content does not break the law or anyone else's rights.

7. Your subscribers and customers

  • For the personal data of your subscribers, customers and site visitors, you are the controller and we are your processor. Our Data Processing Agreement explains how we handle that data.
  • People join your list only through your site's sign-up form, with email confirmation (double opt-in) where it is on. The Service does not let you import lists, and you must not try to get around this (for example by scripting sign-ups).
  • Before you can send marketing email, you must enter your legal business name and postal address. They appear in every marketing email together with a one-click unsubscribe link.
  • You must honour unsubscribes and data requests. The dashboard gives you tools to export, correct, unsubscribe and delete or anonymise a person's data.
  • We monitor bounces and spam complaints. Addresses that bounce or complain are blocked from further sending in your workspace. If your complaint rate is high, we may slow or pause your sending.

8. AI features

  • The AI writer and AI product builder use your own OpenRouter API key. The costs are billed to your OpenRouter account. We do not pay for, and are not responsible for, your AI usage. You can set a monthly cap.
  • Your prompts, the reference files and images you upload, and video links you give it go to OpenRouter and the model provider you choose, under your OpenRouter account and its privacy settings. Some providers may keep or train on prompts. Check your OpenRouter privacy settings.
  • We never put your subscribers', customers' or tickets' personal data into AI prompts.
  • AI output can be wrong, incomplete, unoriginal or similar to other material. Nothing generated is published, sold or sent until you choose to do so. You are responsible for checking and editing AI output before you use it.
  • As between you and us, you own the output you choose to keep, to the extent the law and your AI provider's terms allow. We make no promise that AI output can be protected by copyright or is free of other people's rights.

9. Custom domains

You may connect a custom domain if your plan includes it. You must own or control the domain and keep its DNS records pointing correctly. We use Cloudflare to issue certificates and route traffic for custom domains. Every workspace keeps at least one free platform subdomain.

10. Acceptable use and suspension

You must follow our Acceptable Use Policy. If we reasonably believe your account or site breaks it, puts others at risk or exposes us to legal liability, we may suspend the site or account, with a reason recorded. While suspended for abuse, your public site shows as unavailable and no email goes out except unsubscribe confirmations. Where it is safe and lawful, we will tell you why and give you a chance to fix the problem.

11. Support access to your workspace

To help you or to investigate a problem, our staff may sign in to your workspace dashboard. Each such visit needs a recorded reason, is time-limited (currently 60 minutes), shows a banner, keeps your secret keys hidden and records every action in an audit log. We email the workspace Owner afterwards.

12. Our property

The Service, its software, design and documentation, and The Creator Funnel name belong to us or our licensors. These Terms give you the right to use the Service while your account is active; they do not transfer ownership. Do not copy, resell, reverse-engineer or build a competing product from the Service, except where the law allows. If you send us ideas or feedback, we may use them without owing you anything.

13. Your data, export and deletion

  • Export: the Owner can download a full export of a workspace (data as JSON and CSV, plus product files and media) from the Data screen at any time, including while the account is limited, suspended or cancelled. An export file is kept for 7 days.
  • Deleting a workspace: the Owner can ask to delete a workspace with a typed confirmation and two-step login. The workspace is deleted after a 7-day waiting period, during which you can cancel the deletion.
  • What deletion removes: all of the workspace's data and files, its custom domains, and its encryption key. Copies in our backups are deleted as the backups expire, within 30 days. We keep a short record that the workspace was deleted and the billing records we need for accounting and tax.

14. Availability and changes to the Service

We work to keep the Service running and secure, but we do not promise it will always be available or free of errors. We may carry out maintenance, and we may change, add or remove features. If we remove a major feature you pay for, we will tell you in advance where we reasonably can. We do not offer any uptime commitment or service level agreement (SLA). We provide the Service as is, using reasonable efforts to keep it available.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any sales, sign-ups, deliverability or other business results. We are not responsible for services run by other companies, including Stripe, Resend, OpenRouter, Google, Meta, TikTok, Cloudflare and YouTube.

16. Limitation of liability

To the fullest extent the law allows:

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
  • Our total liability for all claims relating to the Service is limited to the greater of (a) the fees you paid us for the Service in the 12 months before the event that gave rise to the claim and (b) US$100.

These limits do not apply where the law does not allow them.

17. Indemnity

You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from Your Content, your products and sales, your emails, your use of connected services, or your breach of these Terms or the law.

18. Ending this agreement

  • You can stop at any time by cancelling your subscription and, if you wish, deleting your workspaces.
  • We can end or suspend your account if you seriously or repeatedly break these Terms, do not pay, or if we stop offering the Service. If we stop offering the Service, or otherwise end your account for reasons other than your breach, we will give you at least 30 days' notice by email, and Data export stays available during that time so you can download your data.
  • Sections that by their nature should continue (for example payment owed, disclaimers, limitation of liability, indemnity and governing law) continue after the agreement ends.

19. Changes to these Terms

We may update these Terms, the Privacy Policy, the Acceptable Use Policy and the Data Processing Agreement. Each update is published as a new version. You will be asked to accept the new version the next time you sign in; until you do, only Billing and Data export are available. If you do not agree, you can cancel and export your data.

20. Governing law and disputes

20.1 Governing law. These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. The Federal Arbitration Act governs the arbitration agreement in this section.

20.2 Try to settle it first. Before starting arbitration or a court claim, each side agrees to send the other a written notice describing the dispute and to try to settle it informally for 30 days. Send your notice through the contact form or by post to the address in section 22. We will send ours to your account email address.

20.3 Binding individual arbitration. If the dispute is not settled within those 30 days, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules where they apply, and otherwise under its Commercial Arbitration Rules. The seat of arbitration is Maricopa County, Arizona; hearings may be held by video or telephone instead if the arbitrator allows. Fees are paid as those rules provide. The arbitrator may award the same individual relief a court could, but only for the individual party making the claim. Judgment on the award may be entered in any court with jurisdiction. This means you and we each give up the right to go to court and have a jury decide the dispute, except as set out in section 20.4.

20.4 Small claims. Either side may instead bring an individual claim in a small claims court in Maricopa County, Arizona, or in the county where you live, as long as the claim stays in that court and is not brought as a class or representative claim.

20.5 Opting out. You can opt out of this arbitration agreement by sending us written notice within 30 days of first accepting these Terms, through the contact form or by post to the address in section 22. Include your name, your account email address and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

20.6 Class-action waiver. You and we may bring claims against each other only in an individual capacity, and not as a claimant or class member in any class, consolidated or representative action. The arbitrator may not combine more than one person's claims. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) must be heard in court as set out in section 20.7, and not in arbitration.

20.7 Courts. Any dispute that is not arbitrated (including if you opt out, or if the arbitration agreement does not apply or is found unenforceable) will be heard only in the state or federal courts located in Maricopa County, Arizona, and you and we agree to those courts' jurisdiction.

20.8 Consumers outside the US. If you use the Service as a consumer and live in the European Union or the United Kingdom, nothing in this section takes away the protection of mandatory laws of your country, including any right to bring proceedings in your local courts.

21. General

  • These Terms, together with the documents they mention, are the whole agreement between you and us about the Service.
  • If any part is found unenforceable, the rest stays in force.
  • Not enforcing a right straight away does not mean we give it up.
  • You may not transfer your account or these Terms without our written consent. We may transfer them as part of a merger, sale or reorganisation.
  • Neither side is liable for delays caused by events outside its reasonable control.
  • We send notices by email to your account address or in the dashboard. You can send notices to us through the contact form at thecreatorfunnel.com or by post to the address below.
